These Terms and Conditions ("Terms") govern your access to and use of Kilim, including our website, applications, and related services (collectively, the "Service"), operated by N-GRAM ("Company," "we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Account Responsibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for:

  • Providing accurate account information.
  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.

You must notify us immediately at support@getkilim.com if you believe your account has been compromised.

2. Privacy and Data Protection

Your privacy is important to us. Our processing of personal data is governed by our Privacy Policy.

For users in the European Economic Area (EEA), the UK, and Switzerland, we process personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy laws. By using the Service, you acknowledge that we will collect and use your information as described in the Privacy Policy.

3. Use of the Service and AI Features

Kilim provides AI-assisted productivity tools. You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service or related systems.
  • Reverse engineer, decompile, copy, or create derivative works of the Service, except as permitted by applicable law.
  • Upload, transmit, or distribute malicious code or content that infringes third-party rights.

3.1 AI-Generated Content

The Service uses artificial intelligence (including Google Gemini) to generate summaries, suggestions, and "memories" based on your activity.

  • Accuracy: AI-generated content may be inaccurate or incomplete. You should verify any critical information.
  • Ownership: You retain ownership of your input data. We own the underlying AI models and service logic.
  • Usage: We use your data to provide and improve the AI features for your specific account as described in the Privacy Policy.

4. Fees, Billing, and No-Refund Policy

If you purchase a paid plan, feature, or subscription, you agree to pay all applicable fees and taxes. Payments are processed through Stripe, and your use of their service is subject to Stripe's Terms of Service.

All payments are final. No refunds, credits, or prorated reimbursements are provided under any circumstances, including:

  • Partial billing periods.
  • Unused subscriptions or features.
  • Account closure or suspension.
  • Service modifications, downtime, or discontinuation.

5. Intellectual Property

The Service, including all software, content, trademarks, logos, and underlying technology, is owned by the Company or its licensors and is protected by applicable intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.

6. Third-Party Services

The Service depends on and integrates with third-party providers, including:

  • Firebase (Google) for authentication, hosting, and notifications.
  • Google Cloud Platform for infrastructure and AI services (Gemini).
  • Stripe for payment processing.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, for any reason.

9. Governing Law

These Terms are governed by the laws of your jurisdiction, without regard to conflict of laws principles.
